Terms and Conditions | Muhan Energy (SIWSA Pty Ltd)
1. The Agreement
- Entire Agreement: These terms represent the full agreement between the customer and Muhan Energy (Pty) Ltd. No alterations are valid unless agreed upon in writing and signed by an authorized representative of Muhan Energy.
- Modifications: Terms are subject to change. Any order placed is governed by the version of the terms in force at the time of purchase.
- Binding Nature: All sales are final and binding, expressly excluding any conflicting conditions stipulated by the customer.
- Billing: Please ensure all billing details are correct at the time of order; no changes can be made once processed.
2. Quotations & Pricing
- Validity: All quotations remain valid for 7 (seven) days from the date of issue.
- Fluctuations: Prices are subject to exchange rate rulings. Muhan Energy reserves the right to adjust prices for any fluctuations until full payment is received.
- Taxes & Duties: Muhan Energy reserves the right to increase prices in the event of new taxes, duties, or legislative changes that increase the cost of goods prior to delivery.
- Errors: The purchase price is the current price as reflected on the official website.
3. Payment Terms
- Methods: We accept EFT (Electronic Funds Transfer) and Debit Card payments.
- Prohibited: We do not accept cheque payments or cash deposits.
- Verification: Orders will only be processed once funds have cleared in our account. Payment is due in full prior to shipment.
4. Technical Suitability & Installation
- Customer Responsibility: It is your responsibility to ensure that the goods ordered are suitable for your intended use. Please consult our team prior to purchase if you are uncertain.
- Professional Installation: All electrical products must be installed by a qualified professional in accordance with SANS regulations and manufacturer specifications.
- Compliance: A valid Certificate of Compliance (COC) is required for all installations. Failure to provide this documentation will void all warranty claims.
5. Shipping & Delivery
- Proof of Delivery: Any delivery note or waybill signed by you or your representative serves as sufficient proof of delivery.
- Inspection: Goods must be inspected upon arrival. Any visible damage or discrepancies must be noted immediately on the waybill.
- Third-Party Transport: Customers engaging their own couriers indemnify Muhan Energy against any claims arising from transit.
- Timelines: While we endeavor to meet delivery estimates, Muhan Energy is not liable for losses resulting from delayed delivery beyond our reasonable control.
6. Processing & Back Orders
- Processing Time: Orders are typically processed within 2 to 5 business days, depending on stock availability. We do not process orders on weekends or public holidays.
- Back Orders: If an item is delayed, we will notify you and ship the remainder of your order. If a backordered item remains undelivered after 30 days, you may cancel that item with 7 days’ written notice.
7. Cancellations
- Standard Orders: Requests for cancellation must be submitted in writing to sales@muhanenrgy.co.za prior to delivery.
- Custom Orders: No refunds will be issued for deposits or payments on specially ordered or custom-manufactured goods.
8. Warranties & Guarantees
- Manufacturer Warranty: All goods are subject to the specific manufacturer’s warranty. Muhan Energy’s role is to facilitate the warranty claim with the manufacturer on your behalf.
- Exclusions: We offer no warranties on Lead Acid (LA), GEL, or AGM batteries.
- Voidance: Warranties are void if products are misused, physically damaged, tampered with, or installed by unqualified persons.
- Location: All warranty items must be returned to 7 Vernon Terrace Crescent Zonnebloem, Cape Town, 7925 at the customer’s expense. We do not offer on-site warranty services.
9. Returns & Repairs
- Authorization: No returns will be accepted without a prior authorization number from Muhan Energy.
- Handling Fee: A 25% re-stocking fee applies to returns resulting from customer error.
- Condition: Items must be 100% complete, in original packaging, and in resalable condition.
- Repairs: Muhan Energy does not perform repairs. Defective units are handled directly by the manufacturer or their agents. Shipping costs to the manufacturer are for the customer’s account.
10. Limitation of Liability
To the extent allowed by law, Muhan Energy (Pty) Ltd shall not be liable for any consequential, incidental, or indirect loss or damage arising from the supply of goods or circumstances beyond our reasonable control.
11. Service Address
For all legal purposes and notices, the service address shall be the address set out on the customer’s quotation or order form.
